Com a implantação da República em 1889, e a instituição do federalismo pela Carta Magna de 1891, desapareceu a organização de justiça única e introduziu-se em substituição o sistema dual - Justiça Fed ... eral e Justiça dos Estados. Cada unidade da federação passaria a reger-se pelas constituições e leis que adotasse, respeitados os princípios constitucionais da União. Em consonância com essa diretriz, a Constituição Catarinense de 1891, no caput do artigo 49, explicitou que os três poderes - Executivo, Legislativo e Judiciário - seriam independentes e harmônicos entre si, e instituiu o denominado Superior Tribunal de Justiça como órgão de segunda instância, "com as atribuições que a lei confere aos tribunais desta categoria". A instalação do Tribunal de Justiça em Santa Catarina deu-se em 1º de outubro de 1891, na Casa da Câmara, e foi um acontecimento político-administrativo marcante para a História deste Estado. O Superior Tribunal de Justiça era composto inicialmente por cinco membros, denominados desembargadores, escolhidos dentre os Juízes de Direito mais antigos.
